1. Agreement and Definitions
1.1 Acceptance:
By booking a tour with GB Trek and Tours (“Company,” “we,” “us”), you (“Client,” “you”) agree to these Terms and Conditions. These terms constitute a legally binding contract between you and GB Trek and Tours.
1.2 Definitions:

Tour: Any trekking, expedition, or travel service offered by the Company

Services: All arrangements provided including guiding, accommodation, transport
-
Force Majeure: Events beyond our control (see Section 9)

High-Altitude Trek: Any tour reaching above 3,500 meters/11,500 feet
2. Booking and Payment
2.1 Booking Process:

A booking is confirmed only upon receipt of required deposit AND our written confirmation
-
We reserve the right to decline any booking at our discretion
-
You warrant all provided information (especially health data) is accurate and complete
2.2 Pricing:
-
All prices in USD or PKR as specified
-
Prices include items listed in tour description; exclusions listed separately
-
Prices subject to change due to government tax increases or significant currency fluctuations (>10%) with 30 days notice
2.3 Payment Schedule:

Deposit: 30% of total price due at booking
-
Final Balance: Due 60 days before tour start date
-
Late Bookings (<60 days): Full payment required immediately
-
Payment Methods: Bank transfer, credit card (3% processing fee), or cash in Skardu/Islamabad by arrangement
2.4 Consequences of Non-Payment:

Failure to pay balance by due date = automatic booking cancellation
-
Deposit forfeited
-
No reinstatement without Company approval and possible price adjustment
3. Cancellations and Changes
3.1 Cancellation by Client:
Cancellation must be in writing. Refunds based on days before departure:

No refund for unused services during tour.

3.2 Cancellation by Company:

Low Enrollment: We may cancel if minimum participants (typically 4) not met 45 days before departure. Full refund or option to join different date offered.

Significant Changes: If we cancel a major tour component (e.g., K2 Base Camp trek), we offer suitable alternative or pro-rata refund for unused portion
3.3 Changes by Company:
We reserve right to modify:

Itinerary order or route
-
Accommodations (to equivalent standard)
-
Transportation methods
-
Guides and support staff
No refunds for minor changes. Significant changes communicated promptly with options.
4. Client Responsibilities
4.1 Mandatory Insurance:
YOU MUST HAVE ADEQUATE TRAVEL INSURANCE. Proof required 30 days before departure.
Minimum Coverage Required:

Emergency medical evacuation from 6,000m: $200,000 minimum

Repatriation coverage
-
Trip cancellation/interruption
-
Personal liability: $1,000,000
-
Adventure sports/high-altitude trekking coverage EXPLICITLY included
No insurance = no participation. No refund.
4.2 Health and Fitness:

You declare medically fit for chosen tour
-
Recommended: physician consultation before booking
-
Required for high-altitude treks: recent physical examination
-
You must disclose all medical conditions, allergies, medications
-
You are responsible for bringing adequate personal medication
-
Altitude sickness risk acknowledged and accepted
4.3 Documentation:

Valid passport (6+ months validity)

Required visas for Pakistan
-
Permit photos as specified
-
Foreign Registration Card (FRC) upon arrival (we assist)
-
Carry original passport during tour
Company not liable for denied entry or permit issues due to client documentation errors.
4.4 Conduct:
You agree to:

Follow guide’s safety instructions
-
Respect local customs and culture
-
Moderate alcohol consumption at altitude
-
No illegal substances
-
Respect environment (Leave No Trace principles)
Company may terminate your participation, without refund, for:

Dangerous behavior
-
Illegal activities
-
Disruptive conduct affecting group safety
-
Refusal to follow guide instructions
5. Risk Acknowledgement and Liability
5.1 INHERENT RISKS ACKNOWLEDGMENT:
ADVENTURE TRAVEL IN THE KARAKORAM AND HIMALAYAS INVOLVES INHERENT RISKS THAT MAY RESULT IN INJURY, ILLNESS, OR DEATH.
You acknowledge and accept risks including but not limited to:

Altitude sickness (AMS, HAPE, HACE)

Falling rocks, avalanches, landslides
-
Extreme weather conditions
-
Road accidents on mountain roads
-
River crossings
-
Remote location with limited medical facilities
-
Political instability, terrorism
-
Infectious diseases
-
Wildlife encounters
5.2 LIABILITY LIMITATION:
TO THE FULLEST EXTENT PERMITTED BY LAW:

Company’s maximum liability limited to tour price paid

NOT LIABLE for indirect, consequential, punitive damages
-
NOT LIABLE for third-party provider actions (airlines, hotels, etc.)
-
NOT LIABLE for personal injury, property damage, or loss
-
NOT LIABLE for itinerary changes due to safety considerations
5.3 Guide Authority:

Guide’s decision on safety matters is FINAL
-
Guide may modify/abandon itinerary for safety
-
Guide may require client to descend/evacuate due to health
-
Client bears all costs of early evacuation
6. Permits and Regulations
6.1 Government Requirements:

We obtain required permits using your documentation
-
Permit fees included unless specified
-
You must provide accurate information and photos
-
Permit denials by authorities not our responsibility
6.2 Environmental Compliance:
-
Follow all protected area regulations
-
No littering – carry out all waste
-
Respect wildlife viewing guidelines
-
Use designated camping areas
7. Force Majeure
7.1 Definition:
Events beyond reasonable control including:
-
Natural disasters (earthquakes, floods, avalanches)
-
Extreme weather preventing travel
-
Political unrest, war, terrorism
-
Government travel restrictions/advisories
-
Pandemic/epidemic
-
Transportation strikes or failures
-
Flight cancellations/denials
7.2 Force Majeure Response:
-
Itinerary may be modified or cancelled
-
No cash refunds – future travel credit offered
-
Credit valid for 24 months from original tour date
-
Client responsible for additional costs (accommodation, flights home)
-
We assist with rearrangements but not financially liable
8. Dispute Resolution and Governing Law
8.1 Mediation First:
Any dispute first referred to mediation in Skardu, Pakistan
8.2 Governing Law:
These Terms governed by laws of Pakistan
8.3 Jurisdiction:
EXCLUSIVE JURISDICTION: Courts of Skardu, Gilgit-Baltistan, Pakistan
8.4 Class Action Waiver:
No class actions or representative proceedings
9. Miscellaneous
9.1 Entire Agreement:
These Terms + Privacy Policy + booking form = complete agreement
9.2 Severability:
If any provision invalid, remainder continues in force
9.3 Assignment:
We may assign our rights; you may not assign without our consent
9.4 Notices:
Written notices to email/address on booking form
9.5 No Waiver:
Failure to enforce any right not a waiver of that right
10. Acknowledgment
BY BOOKING, YOU ACKNOWLEDGE:

Mr. Nisar Hussain (Late)
Honor: Medal of Honor (posthumous)
Department: Sports (Mountaineering)
Mr. Nisar Hussain has the unique honor of climbing all the five mountains of Pakistan out of the total fourteen mountains of the world above 8000 meters. In 1996, he accomplished the first feat of climbing the mountain. When you reached Sia Kangri (4227 m). In 1999, he accompanied the Korean team to climb Gasherbrum II (8035 meters). In 2000, he once again accompanied the Korean expedition and reached the summit of Broad Peak. In 2003, he summited Gasherbrum II (8035m) and Gasherbrum I (8065m) in a 24-day period with the Korean Expedition. He was selected by Alpine Club Pakistan for the China-Pakistan joint expedition to summit K-2 (8611 m). He proudly hoisted the national flag of Pakistan on the second major peak of Pakistan. In 2008, he summited Nanga Parbat from the side of Diamer with the German expedition and thus became the third Pakistani mountaineer to climb all Pakistani peaks above 8000 meters. In the summer of 2011, he attempted to climb the urban jump ie Gasherbrum I (8068 m), Gasherbrum II (8035 m) and K2 (6118 m) simultaneously. Formed a team together. He summited both Gashe Gasherbrum II and Gasherbrum I along with other international climbers. With a new route on the south face, he chose to be the first Pakistani to climb this difficult peak in winter, as a partner of Gerfried Goshal in a winter expedition to reach the summit of Kater Brim. He was last seen below the summit of Gator Brim 1 on the fateful day of March 9, 2012, along with Gerfried Goschel and Swiss mountaineer Cedric Pehlen, at twelve o'clock when he was disappeared along with his teammates and later. After a search, he was declared missing near the peak.
In recognition of his outstanding performance in the field of sports (mountaineering), the President of the Islamic Republic of Pakistan has awarded the Tamgha-e-Imtiaz (Posthumously) to the late Mr. Nisar Hussain.
